TERMS OF SERVICE (TOS)
If you have a problem with any of these terms please reach out to me, it can be discussed and adjusted prior to paying for your commissioned piece.
1. General Terms
MY ART IS NOT TO BE USED FOR ANY KIND OF AI MODEL TRAINING
All artworks may or will include a subtle sign that you may not remove.
I might record the drawing process and post it on any of my social media.
I retain the rights to my artwork.
Prices are subject to change based on demand.
You will only receive the digital art file. Not the printed art.
I have the right to reject any order that I do not feel comfortable painting for any reason.
My art shall not be uploaded as an NFT.
You cannot claim my art or designs as your own. Please be sure to credit me when posting it on other sites.
My art shall not be resold - that includes an altered version of the artwork (for commercial project look at section 6)
2. Payment
Accepted currency is GBP (British Pound)
Payments are processed through the Artistree system (via Stripe)
Commissions can be paid either 100% upfront or split 50% upfront and 50% before receiving finished artwork.
Don’t send me any payment before I have agreed to give you a slot.
There is a 6,5% platform fee on top of the commission price (For example, if the commission is £100, the customer would pay £106.50 total) This lets Artistree keep the site free for artists to use (and plant trees)!
3. Deadlines
Deadline needs to be discussed and approved before agreeing to a commission
A good deadline is ranging between 1-3 months (usually done within 1 week-1month depending on circumstances)
A deadline shorter than 2 weeks can be (but doesn’t have to be) a subject to a "rush fee" of +20% of comm price
if I manage to finish the commission before the deadline and/or within rush fee time range you are NOT subjected to a rush fee, no worries.
if my work time exceeds the deadline without discussing the change of circumstances with you you're entitled to 50% off
if I do message you about change of circumstances but you fail to discuss it with me, you will lose your 50% off entitlement
4. Process & delivery
I will notify you when I have started on your commission and you, therefore, lose the rights to a refund
While I’m working on your commission I will make reviews with you to make sure you’re satisfied with my work!
The amount of reviews depends on the complexity of the work.
During the reviews, you will see work-in-progress and these images will usually include a watermark and/or will be smaller than the finished piece.
The time it takes to finish your commission varies 1 week – 6 months depending on various factors like complexity of the commission or personal life circumstances and of course discussed deadline
but don't worry, as mentioned in point 3/6 if anything comes up that will slow the progress of the initially estimated delivery time I will let you know asap. (at least 2 weeks in advance if possible)
Once the piece is finished you will receive the full-resolution image along with a web-friendly size via email. Note that there is no physical product.
5. REVISIONS
You get 3 rounds of changes on the commissioned piece included in the price.
A fee will be added if you want something changed on the final drawing – unless a misunderstanding from my side has been made.
If you wish for me to change something in the drawing you have previously approved, the amount of the extra charge will depend on the change you want me to make. I'm pretty agreeable so if it's a small change (for example eye or shirt color) I may not request a fee, but for bigger changes where I would need to seriously repaint the subject (pose, different clothing or backgrund) will be a subject to a fee ranging from £10-£60
please don’t abuse the revisions system, I’m totally happy to help but even god has limits
6. COPYRIGHT | COMMERCIAL PROJECTS
I, Arya Silvart (the artist), claim the rights to the produced artwork, not the client.
Therefore I am allowed to use the copyrighted artwork to:
Promote my business with it everywhere
Use it in publications
Use it as an subject for a tutorial video etc.
I mean the best for my clients so I am open for discussing not putting the commission up on my social media on client's request.
I will never sell merchandise containing a commissioned piece unless I get a written consent from the client.
Is my commission a commercial project?
Commercial Project would be one where the artwork is directly or indirectly resulting in acquiring income
Your commission is NOT commercial if you want to:
print it and hang it on a wall in your bedroom
print it and gift it to someone
set it as profile picture / post it on your personal social media accounts
throw a little house party and use it for decoration
use it for your DnD sessions
Your commission IS commercial if you want to:
print it and sell it as merchandise of any kind
use it for advertisement / brand identity & promotion
use it in online content form to make money
use it in large event as brand identity and sell it as merchandise
In case of a commercial project I will still retain the rights to the intellectual property.
Every commercial project is different so I treat every case individually, however the baseline that would be expected for specific examples could be:
Individual seller wants to sell my designs on their T-shirts under their brand - base commission price + 50/50 sold merch revenue split
Music band wants my art to represent their identity - base commission payment only | If they are selling merch with my art + 10% sold merch revenue
A content creator wants my designs for their streaming/brand identity/content - base commission price only | If they are selling merch with my art + 10% sold merch revenue
a company who has an already established brand identity wants my designs for advertisement purposes - Base commission price only
an event group wants a design that will be shown as advertisement and sold on merch - Base commission price + 15%-20% sold merch revenue
Additionally, In case of a collab between me and another artist resulting in selling of merchandise - 50/50 sold merch revenue split on both sides if both sell the same products separately
